1. Introduction and Acceptance
Welcome to Mobeo (www.mobeo.co.uk). These Terms and Conditions ("Terms") govern your access to and use of the Mobeo website, services, and platform (collectively, the "Service"). The Service is operated by Real People Media Ltd ("we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service. We recommend that you print or save a copy of these Terms for your records.
2. Definitions
- "User" means any person who accesses or uses the Service, whether as a buyer, seller, or visitor.
- "Listing" means any vehicle advertisement posted on the Service.
- "Seller" means any User who creates a Listing to sell a vehicle.
- "Buyer" means any User who enquires about or purchases a vehicle through the Service.
- "Dealer" means a business entity registered on the Service to sell vehicles commercially.
- "Private Seller" means an individual selling a vehicle privately, not in the course of business.
3. Eligibility and Account Registration
3.1 Eligibility
To use our Service, you must:
- Be at least 18 years of age
- Be legally capable of entering into binding contracts
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use of your account
4. The Service
4.1 Nature of Service
Mobeo provides an online platform that connects vehicle buyers and sellers. We do not:
- Own, possess, or control any vehicles listed on the Service
- Act as a party to any transaction between Users
- Guarantee the accuracy of any Listing information
- Provide warranties or guarantees on any vehicles
- Take possession of or transfer title to any vehicles
4.2 Service Availability
While we strive to maintain continuous availability, we do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
5. Listing Rules and Seller Obligations
5.1 Listing Requirements
When creating a Listing, Sellers must:
- Provide accurate, complete, and truthful information about the vehicle
- Only list vehicles they own or are legally authorised to sell
- Include clear and accurate photographs of the actual vehicle
- Disclose all known defects, damage, or issues with the vehicle
- State whether the vehicle has been involved in accidents or has outstanding finance
- Provide accurate mileage readings
- Not misrepresent the vehicle's history, condition, or specifications
5.2 Prohibited Listings
You may not list:
- Stolen vehicles or vehicles with unclear title
- Vehicles subject to outstanding finance without disclosure
- Vehicles that have been written off and not properly declared
- Vehicles that do not meet legal roadworthiness requirements (unless clearly stated as non-roadworthy)
- Counterfeit or cloned vehicles
- Vehicles you do not have authority to sell
5.3 Legal Compliance
Sellers must comply with all applicable UK laws, including but not limited to:
- The Consumer Rights Act 2015
- The Consumer Protection from Unfair Trading Regulations 2008
- The Road Traffic Act 1988
- Data protection legislation
6. Buyer Responsibilities
6.1 Due Diligence
Buyers are responsible for:
- Conducting their own inspections and checks before purchase
- Verifying vehicle history, mileage, and condition
- Arranging independent mechanical inspections where appropriate
- Checking for outstanding finance using services such as HPI or Experian
- Verifying the seller's identity and legal authority to sell
- Ensuring the vehicle meets their requirements
6.2 Transaction Safety
We strongly recommend that Buyers:
- Meet sellers in safe, public locations
- Never transfer money without seeing the vehicle and documentation
- Use secure payment methods
- Be wary of deals that seem too good to be true
- Report suspicious activity to us and the relevant authorities
7. Fees and Payments
7.1 Service Fees
Certain features of the Service may require payment. Current fees are displayed on our pricing pages. We reserve the right to change our fees at any time, with reasonable notice to affected Users.
7.2 Payment Processing
Payments are processed through secure third-party payment providers. We do not store complete payment card details.
7.3 Refund Policy
Fees for listing services are generally non-refundable once the Listing is published. For details on refunds, please contact our customer service team.
8. Prohibited Conduct
Users must not:
- Provide false, misleading, or fraudulent information
- Engage in any form of fraud, scam, or deceptive practice
- Harvest or collect User information without consent
- Interfere with or disrupt the Service or servers
- Use automated systems or software to extract data from the Service
- Attempt to gain unauthorised access to any part of the Service
- Post content that is defamatory, obscene, or otherwise objectionable
- Violate any applicable laws or regulations
- Circumvent or manipulate our fee structure
- Create multiple accounts to abuse promotions or avoid restrictions
9. Intellectual Property
9.1 Our Rights
All content on the Service, including but not limited to text, graphics, logos, icons, images, and software, is the property of Mobeo or its content suppliers and is protected by UK and international copyright laws.
9.2 User Content
By posting content (including Listings) on the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content in connection with the Service.
10. Limitation of Liability
10.1 Service Limitations
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results from using the Service will be accurate or reliable
- Any information provided through the Service is accurate or complete
10.2 Liability Cap
To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
10.3 Exclusions
We shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Actions or omissions of other Users
- The quality, safety, or legality of any vehicle listed
- The accuracy of any Listing information
- The ability of Sellers to sell or Buyers to pay
10.4 Consumer Rights
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Mobeo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you post on the Service
12. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.
13. Termination
13.1 By You
You may terminate your account at any time by contacting us or using the account deletion feature (where available).
13.2 By Us
We may suspend or terminate your account and access to the Service at any time, with or without cause, including if we believe you have violated these Terms.
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
14. Dispute Resolution
14.1 Between Users
Disputes between Users regarding vehicle transactions are solely between those Users. We are not responsible for resolving such disputes but may assist in facilitating communication where appropriate.
14.2 With Mobeo
If you have a dispute with us, please contact us first to try to resolve it informally. These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to Terms
We may modify these Terms at any time. We will notify Users of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Mobeo regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
